I’ve been researching the EUA issue, in addition to the permanent liability immunity that the manufacturers get, if Pfizer, Moderna and FDA get the shots on the childhood vaccine schedule.
The EUA legal structure applies to both the injections and to masks, for as long as the state of emergency declarations are still in place. (They are still in place, through WHO, through Presidential state of emergency declarations, and through US-HHS public health emergency declarations.)
The EUA structure was set up in 2004 and 2005 through two sets of amendments to the 1944 Public Health Services Act: Project Bioshield Act of 2014, and PREP Act of 2005.
Azar’s PREP Act declaration bestowed immunity for liability on developers, manufacturers, distributors and ‘vaccinators,’ for injuries and deaths caused by vaccines developed, manufactured, distributed and administered under Emergency Use Authorization.
The only exception is for “willful misconduct,” which might apply to Pfizer and Moderna if the clinical trial fraud alleged by whistleblower Brook Jackson can be proved — as Edward Dowd and others are working toward. But it would probably not apply to distributors and injectors who can credibly claim they had no knowledge of the clinical trial fraud.
HHS Secretary Azar’s declaration also rendered contractors like Pfizer, Moderna, nurses and pharmacists, as classifiable, in legal terms, as government employees of the Department of Health and Human Services for purposes of the Federal Tort Claims Act and related laws: 28 USC 1346(b) and 28 USC 2672.
Even worse, some courts have already interpreted the laws as having “sweeping” power to preempt federal and state civil laws, to shield manufacturers and vaccinators from liability for injury and death even when the treatment was given without consent. The 2012 case Parker v. St. Lawrence, 102 A.D.3d 140 addressed H1N1 ‘vaccines’ given in 2009 after that pandemic declaration, including to a kindergarten child without her mother’s consent.
I don’t know if that case was appealed or overturned on appeal if so. Still researching.
